To become a member of ArtistColony.com, you must agree to certain policies.
These policies are in place to make ArtistColony.com the best art site on the
internet, both for you and visitors to your gallery. Some of the policies are
general policies relating to general maintenance of the site. Other policies
deal specifically with the selling of artwork directly on ArtistColony.com
through our secure online credit card process. Please review the agreement
carefully and click continue if you agree with the policies.
General Policies
1. Artist agrees to pay $19.95 each month for the right to have an online
gallery within ArtistColony.com. This includes, but is not limited to the
displaying of showings, classes, workshops, and 25 pieces of artwork.
2. Termination of Use - If at any time you wish to terminate the use of
our services, you must do so in written form and postmarked ten days before
the next billing cycle begins.
3. Disclaimer - We strive to provide uninterrupted and error free service of
our site. If any interruptions do occur, ArtistColony.com will not be held
liable for loss of wages or payments.
4. Amendments - We reserve the right to modify the terms and
conditions listed within this document at any time and to our discretion.
You will be notified via email or telephone that the agreement has been
updated. If you disagree with the amendment you must terminate the
agreement. Continued use of the site is the implied agreement of the amendment.
Policies Related to Selling Artwork on ArtistColony.com
5. Commissions - Commissions will only be paid to ArtistColony.com if the
artwork is purchased using ArtistColony.com's secure online credit card
payment system. You may negotiate with buyers directly and avoid paying
ArtistColony.com a commission.
6. Commissions - You agree to pay a 10% commission on all sales made using
ArtistColony.com's secure online credit card payment system. The commission
total shall not exceed $200 for any single item. Please read below for
specific examples of what the commission would be based on the sale price
of your artwork.

7. Commissions - A buyer has 7 days in which they can return any artwork
purchased from ArtistColony.com. After the 7 days has elapsed, LinkWarp.com
(parent company of ArtistColony.com) will mail a check to the artist for
the sale price of the artwork plus shipping minus any commission due
ArtistColony.com.
8. Shipping Costs - It will be the artist's responsibility to put in a
figure for shipping costs when entering artwork. Please be aware
that some shipping companies require you to prepare your artwork for
shipping. We recommend that you enter a dollar value
that will cover the highest shipping cost you will encounter within the
United States.
9. Shipping - You agree to ship the actual artwork within 48 hours if
possible. If delivery will be delayed or if the piece is no longer available,
we ask you to contact us so that we may notify the buyer. You should also
mark the piece as sold or remove it from your ArtistColony.com gallery. Also,
you should try to have an alternative method of shipping if you plan to be
out of town for an extended time period.
10. Shipping - You will need to pay the shipping cost at time of shipment.
You will be reimbursed the shipping cost equal to the amount you assigned
to the artwork after the buyer receives and accepts the artwork.
11. Insurance - Please be sure to include the cost to insure your item in the
shipping cost. It is your responsibility to insure the piece when shipping
it to the buyer. ArtistColony.com is not responsible for damaged or lost
artwork that results from the shipping process. Buyers will be required
to agree to the same terms if they decide to return a piece.
12. Damaged during Shipment - You are responsible to make a claim with the
shipping company if the buyer receives artwork that was damaged during the
shipping process.
13. Return Policy - Buyers may return any artwork purchased through
ArtistColony.com within 7 days of receipt. If they decide to return
artwork, it is their responsibility to pay for the shipment, including
insurance. Again, ArtistColony.com is not responsible for artwork damaged
at any time.
14. Payment - You will be mailed a check as soon as the 7-day waiting
period has elapsed. This check will be for the total purchase price plus
the cost to ship it to the buyer minus ArtistColony.com's commission.
